1. About these Terms
These Website Terms of Use (“Terms”) govern access to and use of opspera.com (“Website”), operated by Opspera Technology Group (“Opspera,” “we,” “us,” or “our”). The Website provides business and service information and a way to contact us.
Please review these Terms before using the Website. If you do not agree, do not use it. Contractual provisions apply only to the extent a binding agreement is formed and applicable law permits enforcement. These Terms do not establish a paid client engagement.
2. Website information and client engagements
Website descriptions, geographic coverage, technology lists, examples and statements of approach are general information, not binding quotes, warranties, promises of availability or guarantees of security, compliance, uptime, recovery or business results.
An inquiry, discovery-call request or preliminary discussion does not by itself establish a client relationship, authorize work or create a support or response-time obligation. Services require a separately accepted agreement covering scope, fees, responsibilities and other terms.
These Terms do not amend, replace or override a client agreement. Contracted services and associated liability remain governed by that agreement and applicable law.
3. Permitted use
You may use the Website lawfully to learn about Opspera, evaluate services and contact us. You may print or download reasonable portions of publicly available content for personal or internal business reference, retaining ownership notices and identifying the source.
This permission does not allow resale, commercial redistribution, misleading republication or use of our branding to suggest endorsement. Rights independently granted by applicable law remain unaffected.
4. Prohibited activities
You must not:
- Violate law or another person's rights; impersonate others; or send fraudulent, threatening or harassing communications.
- Send spam, misuse forms or submit sensitive information without appropriate authorization.
- Introduce malicious code, seek unauthorized access, bypass controls or interfere with availability.
- Conduct vulnerability scanning, penetration testing or similar testing without prior written authorization.
- Use automated requests to materially overload or disrupt the Website.
- Collect personal information without authorization, remove ownership notices or misrepresent content as your own.
Report suspected vulnerabilities to contact@opspera.com. Do not include credentials or sensitive records in the initial report or continue unauthorized testing.
5. Ownership and third-party trademarks
Original content and design are owned by Opspera or used with permission and protected by applicable intellectual-property laws. Except for Section 3 or rights provided by law, no license is granted.
Third-party product names, company names, trademarks and logos belong to their respective owners. Their appearance identifies technologies or organizations discussed; it does not, by itself, imply sponsorship, endorsement, partnership or certification.
6. Inquiries and communications
Provide accurate information and only material you are authorized to share. Do not send passwords, credentials, payment-card details, government identifiers, health records or other sensitive or regulated information through the public form or ordinary email. Ask us to arrange an appropriate sharing method.
You retain ownership of submitted material. You authorize us to receive, review and use it only as reasonably necessary to respond and administer the related communication, consistent with the Privacy Policy, applicable law and any separate agreement. This is not permission for unrelated publication or marketing.
Submission does not guarantee delivery, an immediate reply or a particular response time. Existing clients should use agreed support and escalation channels for urgent incidents.
7. Privacy and personal information
Our Privacy Policy describes information handling, including contact forms, first-party IP collection, theme storage and third-party services. These Terms do not replace it, provide blanket consent or authorize processing beyond applicable law.
Nothing here waives privacy rights or statutory duties that cannot lawfully be waived.
8. Third-party content and services
Links and embedded services may include maps, fonts, security verification and vendor icons. We do not control their content, availability or independent practices. Their terms and privacy policies may apply; a reference is not necessarily an endorsement.
To the extent permitted by law, we are not responsible for independent third-party acts, omissions, content, interruptions or security failures. Our own non-waivable duties concerning selection or use of providers remain unaffected.
9. Information accuracy and reliance
We aim to provide useful information, but it may be incomplete, inaccurate or outdated and may change without notice. It is not a substitute for an assessment of your environment or system-specific advice.
Do not rely on general content as an implementation plan, compliance determination, security assurance, investment recommendation or legal advice. Evaluate suitability before acting. Specific recommendations and commitments must be addressed through an appropriate engagement.
10. Website warranties and availability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND GENERAL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
WE DO NOT WARRANT CONTINUOUS OR ERROR-FREE ACCESS, COMPLETE OR CURRENT INFORMATION, OR FREEDOM FROM HARMFUL CODE. YOU ARE RESPONSIBLE FOR APPROPRIATE DEVICE SECURITY, BACKUPS AND VERIFICATION BEFORE RELYING ON CONTENT.
This concerns the public Website, not warranties expressly agreed in a client contract. Mandatory legal protections remain unaffected.
11. Limitations of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OPSPERA AND ITS OWNERS, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES ARISING FROM WEBSITE USE, INABILITY TO USE THE WEBSITE, OR RELIANCE ON GENERAL CONTENT. EXCLUDED LOSSES INCLUDE LOST PROFITS, REVENUE, BUSINESS OPPORTUNITIES, GOODWILL, BUSINESS INTERRUPTION, AND LOSS OR CORRUPTION OF DATA, WHETHER OR NOT FORESEEABLE OR WE WERE ADVISED OF THEIR POSSIBILITY.
These exclusions do not apply to fraud, gross negligence, willful or wanton misconduct, or liability, statutory remedies or duties that applicable law does not permit us to exclude or limit. Where a restriction is not permitted, it applies only to the lawful extent.
This section does not govern contracted IT services or override a client agreement. It does not waive non-waivable privacy rights, statutory duties or regulatory enforcement powers.
12. Access restrictions and changes
We may modify content or features, suspend access for maintenance or restrict access as reasonably necessary to address misuse, security threats or legal requirements. Website restrictions do not themselves terminate a client engagement.
Revisions to these Terms will be posted with an updated date and apply prospectively, not retroactively to accrued claims. We will provide additional notice or seek agreement where required. Posting or continued use alone does not override applicable acceptance requirements.
13. Georgia governing law and venue
Subject to mandatory applicable law, these Terms and public Website-use disputes are governed by Georgia law, without regard to conflict-of-law rules.
To the extent a binding agreement exists and applicable law permits, exclusive venue is in state courts located in Fulton County, Georgia, or, where federal subject-matter jurisdiction exists, the United States District Court for the Northern District of Georgia, Atlanta Division. The parties consent to personal jurisdiction there and waive objections based solely on inconvenient forum to the lawful extent.
This does not create federal jurisdiction, eliminate a mandatory right to another forum, require arbitration or waive a jury trial. Client-agreement dispute provisions govern contracted services.
14. General provisions
If a provision is unenforceable, the remaining provisions continue to the extent permitted by law. Failure to enforce a provision on one occasion is not a waiver on another. Website use does not create employment, agency, partnership or joint-venture status.
No provision limits rights or obligations that cannot be limited under applicable law.
